Dear Friends,
We have to search in interet and find the best possible lawyers, we can write here the web site and contact details and after to have different I will prepare a e-mail to explain the case to all of them and I will ask all of them the opinion, then we will know if we can do something or not.

I am also going to contact a legal advisory department from a bank. I suggest, we share all our feedback with Admin by email and then he can summarize that to communicate with all. What do you think?

Is the question, then the lawyers work together when everyone here has a new lawyer?

Is the question, then the lawyers work together when everyone here has a new lawyer? If some of us can seek for some kind of legal advice before we organise ourselves for the next step, we will be able to share those legal opinions. An efficient way might be to direct all these feedbacks to Admin and he can summarize. In this way, we will be able to have an estimate of possible outcome and how big is the chance that we might be able to recover some of the unacceptable loss.

In my opinion what we should do is to find the best lawyers possible in Denmark, then we can send them all the information about our problem. They have to read careful the ''General Terms and Conditions'' then they will advise us if we can proceed in the legal way. If the reply is positive and we can win the case, we have to chose one lawyer to go together. Before to proceed in the legal way, we have to send to Saxo Bank one letter through the lawyer asking to give our account back with the balance before the re-quoted price, if Saxo Bank does not agree then we proceed in the legal way with our lawyer.
What do you think?
From my side and searching the lawyer to show the case, I will inform you as soon as possible. I want to find very strong and good lawyer, this case will be very hard, maybe Saxo Bank pay money to them to forget us or something like that, we are talking about very big amount of money with all of us together.
Best regards
Martin

Hi all! I am from Norway, but I belive I can attend a lawsuit in Denmark. To my knowledge Saxo Bank is not a registrated bank/institution in Norway. I spoke with the "complaint board for financial misbehavior" in Norway(Finasklagenemda)and Saxo Bank is not registrated.
Should we start with a letter to Pengeinstitutankenævnet?
I had four stoploss-orders executed at 1.200, 2x1.2004 and 1.2005 in the timeframe 10.30.45-10.30.48
By the way, I belive that Denmark is a wellfunctioning and transparent society where it is not possible to pay off lawers?? Hopefully I am right...

Hello, I have talked to my laywer in Munich Germany specialized in Banking and Investments. Let me share my learnings.
There a 2 strategies:
1) Complain and wait (let them take action than): this makes sense if you have a negative balance and just do not want to pay this negative balance. Advantage: Saxo needs to sue you in your country with your country protection laws e.g. in Germany Saxo do not have AGB in German, but only intern. Terms and Conditions. If they do not have a German AGB than private investors are protected somehow. Also they need to prove the correct prices. Disadvantage: You do not get the full amount of the incorrect loss, but just the negative balance you do not pay. Chances are better in general.
2) Sue Saxo: If you want to get the full difference to the correct prices (what ever the correct one is e.g. when the deals were confirmed in the first run in the morning vs the adjustment in the evening) Disadvantage: You have to sue them in their country, e.g Danmark in my case, since they do not have a german office. Cost and effort might be higher to engage a lawyer there and is more complicated than. He does not know the Dannish protection. If they win you have to pay all also the negative balance. Advantage: If you win you get the full difference before adjustment. Settlement in between also possible.
His recommendation for me was No 1 and to complain and wait. Do not pay and stop all business with them.
Cost options for all activities out of court (in court this is separate):
A) € 3000 flat if he also would have more customers/mandates he would offer 2000 flat. (depends on amount of money at risk). B) 250 Euro per hour C) Nothing if I complain myself and wait (makes only sense for strategy 1). When they accept good if not I can go back to him. ad C) Disadvantage might be: If they do not see a lawyer involved they might further try and sue.
However, if a lawyer is needed bundling would reduce the cost.
What feedback do you have from your lawyers (usually the first meeting is free here in Germany at least).
Best Thomas

Thanks Thomas, I have a lawyer appointment tomorrow. Yeah, flat fee is always around €3'000. Personally, I already sent a letter with signature and proof of delivery to Saxo Bank Switzerland to let them know I disagree with the price. Beginning of this week, they asked me to pay the negative amount.
So, now, either I send one more letter myself saying I won't pay or I ask my lawyer to send them a letter saying I won't pay.
Best, Louis

Hello Vegard
I think it will be very useful to support our cases to have screenshots of your trades executed between this timeframe which is supposed to be the timeframe that they had no liquidity!!!
Can you please upload or send to my personal address? aris@misoulis.org
Thanks a lot
